By accessing our Site or placing an order, you agree to be bound by these Terms. Please read them carefully, as they outline the rights and responsibilities of both you, our valued customer, and Raintree Nursery.
Our mission is to bring the joy of growing to your doorstep. Just as we nurture each Apple Rootstock and Asian Pear with meticulous care, we are committed to providing a transparent, fair, and satisfying experience for every gardener we serve.

Website & Store Style: Our digital nursery reflects a commitment to expertise, care, and community. We provide detailed information to empower your gardening success, fostering a relationship built on trust and shared passion for cultivation.
Product Characteristics: We specialize in living, dormant plants including fruit trees (Apples, Cherries, Pears, Plums), berries (Blueberries, Blackberries, Strawberries), rootstocks, and unique varieties (Aronia, China Blue Vine). Our products are perishable biological organisms, which fundamentally shapes our policies regarding shipping, guarantees, and returns.
2. User Obligations and Account Responsibility
By using our Site, you agree to:

- Ensure your shipping address is correct and accessible for delivery.

We reserve the right to refuse service, terminate accounts, or cancel orders at our discretion, particularly in cases of suspected fraud, violation of these Terms, or provision of inaccurate information.
3. Products and Services Description
We offer a curated selection of bare-root and live plants, as well as related gardening tools and accessories.
- Live Plants: Sold in a dormant, healthy state suitable for transplanting. Specific varieties (e.g., Apple Rootstock, Cider Apple Trees, Combo Fruit Trees) have unique growth requirements detailed on their product pages.
- Product Availability: All items are subject to stock. We display availability as accurately as possible but may occasionally encounter shortages.
- Product Information: We strive for accuracy in descriptions, images, and care instructions. However, slight natural variations in plant size, form, or eventual fruit yield may occur.
4. Ordering, Pricing, and Payment Terms
Order Process:
- Order Placement: Adding items to your cart does not reserve them. An order is confirmed only upon receipt of payment authorization.
- Order Confirmation: You will receive an email confirmation detailing your order.
- Order Processing: Orders are processed within 1-2 business days. During this time, we carefully select, pack, and prepare your plants for shipment.
- Order Changes/Cancellations: Contact us immediately at [email protected] if you need to modify or cancel an order. We can only accommodate requests before the order has entered the shipping process.
Pricing & Payment:
- Prices are listed in US Dollars (USD) and are subject to change without notice.
- You are responsible for any applicable sales tax, customs duties, or import fees levied by your country. These are not included in our prices.
- Accepted Payment Methods: We accept secure payments via Visa, MasterCard, JCB, and PayPal.
- Payment is captured at the time of order placement.
5. Shipping Policy
Shipping Regions: We ship globally, excluding certain remote regions and parts of Asia. Restrictions are based on carrier limitations and international phytosanitary regulations.
Shipping Methods & Timelines:
- Standard Shipping: Via DHL or FedEx. A flat rate of $12.95 applies. Estimated delivery is 10-15 business days after shipment.
- Free Shipping: For orders over $50, shipped via EMS. Estimated delivery is 15-25 business days after shipment.
Delivery Estimates: Provided timelines are estimates. Actual delivery may vary due to customs clearance, weather events, carrier delays, or other factors beyond our control. You will receive a tracking notification once your order ships.
Receiving Your Order: Please inspect all packages immediately upon delivery. It is your responsibility to provide a deliverable address and to receive the shipment. We are not liable for packages lost or delayed due to incorrect addresses provided by the customer.
6. Returns, Exchanges, and Guarantee
Our policy is designed to be fair, recognizing the living nature of our primary products.
Our Plant Health Guarantee:
We guarantee that all plants will arrive in a healthy, dormant condition. If a plant arrives dead or severely damaged, we will replace it (subject to stock) or provide a store credit/refund.
The guarantee does not cover issues arising after planting, including failure to thrive, leaf drop, or fruit production problems related to local conditions, planting practices, or care.
Eligible Returns/Exchanges:
- Non-plant merchandise (tools, books, accessories) in original, unused condition within 15 days.
- Live plants that arrive dead or severely damaged.
- Incorrect items shipped due to our error.
Process & Timeline:
- Initiation: All requests must be initiated within 15 days of delivery by emailing [email protected] with your order number, details, and photos (for plant issues).
- Authorization: Do not ship items back without a Return Merchandise Authorization (RMA) number from us.
- Refunds: If approved, refunds to the original payment method are processed within 5-7 business days. Original shipping fees are non-refundable unless the error was ours.
- Exchanges: Subject to availability. For plant variety exchanges, contact us. Price differences will be adjusted via charge or store credit.
7. Intellectual Property
All content on this Site, including text, graphics, logos, images, photographs, and software, is the property of Raintree Nursery or its suppliers and is protected by United States and international copyright and trademark laws. You may not reproduce, distribute, modify, or create derivative works from any content without our express written permission.
The Raintree Nursery name, logo, and all related product names are trademarks of Raintree Nursery. You may not use these marks without our prior written consent.
8. Limitation of Liability
To the fullest extent permitted by law, Raintree Nursery shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, or other intangible losses, resulting from:
- Your access to or use of or inability to access or use the Site.
- Any conduct or content of any third party on the Site.
- Any content obtained from the Site.
- Unauthorized access, use, or alteration of your transmissions or content.
- The failure of any plant to thrive, bear fruit, or survive after delivery, due to local conditions, acts of nature, or care.
- Delays or failures in delivery due to events beyond our reasonable control (force majeure).
Our total liability for any claim arising under these Terms or your orders shall not exceed the total amount you paid for the specific product(s) giving rise to the claim.
9. Governing Law and Changes to Terms
These Terms shall be governed by and construed in accordance with the laws of the State of Washington, USA, without regard to its conflict of law provisions.
We reserve the right to update or modify these Terms at any time. The “Last Updated” date at the top of this page will indicate changes. Your continued use of the Site after any change constitutes your acceptance of the new Terms.
